Please read these Terms of Use carefully before accessing or using any part of the Simple Yard platform. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, you must not use our services.

1. Definitions

Throughout these Terms of Use, the following terms carry the meanings defined below:

Platform refers to the Simple Yard website, web application, and all associated services available at simpleyard.eu.
User refers to any individual who accesses, browses, registers on, or otherwise uses the Platform.
Account refers to the registered profile created by a User to access personalized features of the Platform.
Content refers to all text, images, audio, video, quizzes, assessments, learning materials, and other data available on or through the Platform.
We, Us, Our refers to Simple Yard and its authorized representatives.

2. Eligibility

You must be at least 13 years of age to use this Platform. If you are under the age of majority in your region, you must have the consent of a parent or legal guardian before using our services. By using the Platform, you represent and warrant that you meet these eligibility requirements.

We reserve the right to verify eligibility at any time and to suspend or terminate access where eligibility requirements are not met.

3. Account Registration

3.1 Creating an Account

Certain features of the Platform require you to register for an Account. When registering, you agree to provide accurate, current, and complete information and to keep that information updated at all times.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at contact@simpleyard.eu if you suspect any unauthorized access to your Account. We are not liable for any loss or damage arising from unauthorized use of your Account where such use results from your failure to protect your credentials.

3.3 One Account Per User

Each User may maintain only one active Account. Creating multiple Accounts to circumvent restrictions, bans, or limitations is strictly prohibited.

4. Permitted Use

You may use the Platform solely for lawful, personal, and non-commercial educational purposes unless you have entered into a separate written agreement with us permitting commercial use.

Permitted uses include:

Accessing and completing quizzes, tests, and learning modules made available to you.
Reviewing your own results, progress records, and feedback.
Communicating with the Platform through designated contact or feedback channels.

5. Prohibited Conduct

You agree not to engage in any of the following:

Copying, reproducing, distributing, or publicly displaying any Content without our prior written permission.
Attempting to reverse-engineer, decompile, or otherwise extract source code from the Platform.
Using automated tools, bots, scrapers, or scripts to access, collect, or interact with the Platform.
Submitting false, misleading, or fraudulent information during registration or while using the Platform.
Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
Engaging in any conduct that disrupts, damages, or impairs the functionality or integrity of the Platform.
Attempting to gain unauthorized access to any part of the Platform, its servers, or connected systems.
Uploading or transmitting any malicious code, viruses, or harmful data.
Using the Platform to harass, threaten, or harm other users or third parties.
Circumventing any technical measures we use to enforce these Terms.

6. Intellectual Property

6.1 Our Content

All Content on the Platform, including but not limited to quiz questions, instructional materials, graphics, logos, and software, is the property of Simple Yard or its licensors and is protected by applicable intellectual property laws. No Content may be used, reproduced, or distributed without our express written consent.

6.2 User-Submitted Content

If the Platform allows you to submit feedback, responses, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, store, and process that content for the purposes of operating and improving the Platform. You represent that you have all necessary rights to grant this licence.

6.3 Trademarks

The Simple Yard name, logo, and associated marks are trademarks of Simple Yard. Nothing in these Terms grants you any right to use our trademarks without prior written permission.

7. Quiz and Assessment Integrity

The Platform is designed to support genuine learning and knowledge assessment. You agree to:

Complete all quizzes and assessments independently and honestly unless collaboration is explicitly permitted.
Refrain from sharing quiz questions, answers, or assessment content with others in any form.
Refrain from using unauthorized aids, tools, or external assistance during timed or scored assessments.

We reserve the right to invalidate results, suspend, or permanently ban Accounts where assessment integrity violations are detected.

8. Third-Party Links and Services

The Platform may contain links to third-party websites or services. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party service. Accessing third-party services is at your own risk.

9. Disclaimer of Warranties

The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that:

The Platform will be uninterrupted, error-free, or free from harmful components.
Any Content is accurate, complete, or current.
Results obtained through use of the Platform will meet your expectations or requirements.

Your use of the Platform is entirely at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Simple Yard shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to these Terms or your use of the Platform shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred Canadian dollars (CAD $100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Simple Yard and its officers, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

13. Modifications to the Platform

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.

14. Changes to These Terms

We may revise these Terms of Use at any time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.

15. Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without notice, for conduct that we determine violates these Terms or is otherwise harmful to other users, us, or third parties.

Upon termination, all licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimer, limitation of liability, and indemnification provisions.

16. Governing Terms

These Terms constitute the entire agreement between you and Simple Yard regarding your use of the Platform and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
